📄 Terms and Conditions for Video Editing Services

1. Scope of Services

Emporiant (legal entity: Anto Markunovic) provides video editing services to clients on a freelance and project basis. These services include, but are not limited to:

  • Video cutting and sequencing

  • Color correction and grading

  • Visual effects and animation

  • Audio editing and sound design

  • Export formatting for platforms such as YouTube, Instagram, TV, or web

Each project’s scope, timeline, and pricing are outlined in a written agreement (offer, invoice, or package) and must be accepted before work begins.

2. Client Responsibilities

The client agrees to:

  • Provide all required materials (video footage, audio files, brand assets, briefings, etc.) in a timely and structured manner

  • Confirm they hold all necessary rights for submitted materials

  • Respond to review and revision requests within a reasonable timeframe (usually within 5 business days)

  • Provide clear feedback within the defined revision rounds

3. Delivery & Revisions

  • Delivery timelines vary depending on the package and current workload and will be communicated individually

  • Each package (Bronze, Silver, Gold) includes a set number of revisions. Extra revisions are billed at Emporiant’s hourly editing rate unless otherwise arranged

  • Final videos are delivered in MP4 format. Alternate formats (e.g., MOV, ProRes, 4:5, 9:16) must be discussed in advance

4. Payment Terms

  • Full payment is required before the delivery of the final product unless otherwise agreed

  • For monthly subscriptions, payment is due on the day of the original signup. Failure to renew will result in termination of service and file access

  • Large projects may require a 50% deposit upfront and 50% upon completion

  • Accepted payment methods include bank transfer and any method specified on the invoice

  • Late payments may incur reminder fees and default interest according to Austrian Commercial Code (UGB)

5. Copyright & Usage Rights

  • Clients retain full ownership of their original materials

  • Emporiant reserves the right to use finished works in its portfolio, social media, or marketing unless explicitly restricted by NDA

  • The client is responsible for securing rights to any third-party content (music, stock footage, logos, etc.), unless Emporiant provides licensed material as part of the service

6. Cancellation & Refunds

  • Either party may cancel a project in writing

  • If work has already commenced, partial refunds may be offered based on project progress

  • No refunds are available after final delivery

  • Deposits are generally non-refundable unless otherwise agreed

7. Liability

Emporiant is not liable for:

  • Delays due to force majeure (illness, outages, hardware failure, etc.)

  • Legal issues stemming from client-provided content

  • Platform-related problems (e.g., YouTube strikes, compression artifacts, etc.) after final delivery

8. Data Protection

All data is handled in compliance with GDPR. Client files are securely stored and may be retained for up to 12 months unless early deletion is requested. More details can be found in our Privacy Policy.

9. Jurisdiction

These Terms are governed by Austrian law. The place of jurisdiction for all disputes is Graz, Austria.

10. Agreement

By requesting or accepting services from Emporiant, the client confirms they have read and agreed to these Terms and Conditions.
